NEW DIVORCE FORMS IN FEDERAL MAGISTRATE’S COURT.

As part of a review of existing forms, the Federal Magistrate’s Court has unveiled a new suite of forms for use in Divorce proceedings. 

The new forms will be introduced as from 5 February 2007 and are available on the internet at www.familylawcourts.gov.au and the Family Law Registries. 

The new forms are:

Application for Divorce – this form has been designed to be more user friendly and less complicated.  It comes with a kit which assists Applicants in completing the form.

Response to Divorce – this form replaces the existing Response (Divorce or other principal relief) and Response Objecting to Jurisdiction.

Divorce Service Forms:

  1. Affidavit of Service by Hand (Divorce) – used when an application is personally served on the Respondent.
  2. Affidavit of Service by Post (Divorce) – used where the Respondent is served by post.
  3. Affidavit Proving Signature (Divorce) – used to identify a signature appearing on an Acknowledgement of Service (Divorce).
  4. Acknowledgement of Service (Divorce)

The forms have been designed to be more user friendly and will be of great assistance to parties wishing to apply for divorce without the assistance of a lawyer.

However, any person considering divorce should seek legal advice before deciding what to do. A lawyer should explain your legal rights and the legal consequences of any actions you might be considering.
