SECTION 66 CLAIMS FOR PSYCHOLOGICAL INJURY - THE REALITY

Changes to the Workers Compensation Act 1987, commencing 1/1/02, introduced a claim for permanent impairment for psychological injury caused by or substantially contributed to by work.

Sounds good in theory. However, these claims are only possible where the injured worker is classified as having a 15% whole person impairment arising from the psychological injury.

Three years on, our experience is that very few people obtain an assessment of this magnitude.
