Fair Work Act 2009 – Are you compliant?

The final stage of the Fair Work Act 2009 came into effect on 1 January 2010, with the introduction of Modern Awards. We suggest that all Employers take the time to ask themselves the following questions:

1.       Does a Modern Award apply to any of my employees? 

2.       If a Modern Award applies, are we providing the employee with the minimum entitlements under the Modern Award?     

3.       Do any transitional pay arrangements apply? 

4.       If my employees are award exempt, does the current contract of employment comply with the National Employment Standards (NES)?  

5.       If I am a small business employer, am I familiar with the Small Business Fair Dismissal Code?
